To calm any fears you may have regarding filing for Chapter 7 bankruptcy, consider these things: Chapter 7 bankruptcy is usually simple and quick. Bankruptcy is often the right choice if you: · Are paying only minimum amounts on your bills · Do not have enough money to take care of your necessities after paying bills · Your are behind on your mortgage or loans · You are being threatened with foreclosure · Lost your job · Have large medical bills due to an illness or surgery Chapter 7 bankruptcy eliminates most unsecured debt. Some examples of unsecured debt are credit cards, medical bills, most personal loans, and judgments against you (excluding child support, alimony, most taxes, most student loans, and a few others). In most cases, arrangements can be made for you to keep your home, your vehicle, and your personal belongings. Let me tell you how Centracchio Law will help. First I will meet you for a free initial bankruptcy consultation. In this consultation, I will examine your income for the past six months. If your income is below the median income for a family your size in Missouri, you will be eligible for bankruptcy. If you make more than the median income for a family your size in Missouri, your income over the past six months and certain expenses are considered to see if you pass the “means test.” The “means test” determines if you can pay at least $6,000 ($100/month) to unsecured creditors over five years. If you are able to pay this then you will not qualify for a Chapter 7 bankruptcy. However, Chapter 13 bankruptcy is still an option. After I have checked your median income, and if necessary calculated a means test, I will guide you on completing a pre filing credit counseling class. After I have the certificate that you completed the class, we will meet again, sign all of your paperwork, and I will file your bankruptcy petition with the Court. Good News!!! Your creditors MUST stop contacting you!!! Risk of having your car repossessed ends!!! Garnishments stop!!! Your car payment could be lowered using the reaffirmation process!!! You might pay off your car for its actual value – not what you owe on it by using the redemption process!!! We will discuss your house, vehicles, and any other assets you have to determine what option is best for you. I will notify you of who the Trustee is, when and where your “Meeting of Creditors” will be held, and give you additional information on what to bring to this meeting. The meeting is approximately 30 days from the day your bankruptcy petition is filed. Do not worry, I will be at this meeting to help you. You will be sworn in and the Trustee will ask you questions. All of your creditors are notified of your bankruptcy filing and they can attend this meeting but they seldom attend. I will also guide you in timely completing a final financial management course that must be filed with the Court. The Court orders a discharge of your unsecured debts approximately 60 days after the Meeting of Creditors provided there are no objections from your creditors. Again, do not worry --- I will be here for each step and to answer your questions throughout the process. Yes, bankruptcy will be on your credit report for up to 10 years, but the stigma associated with bankruptcy is much lower than you might think. St. Louis is my hometown. I attended the University of Missouri – St. Louis where I earned both a Bachelor of Science and Master of Arts in Criminology and Criminal Justice. I earned my Juris Doctorate from St. Louis University School of Law. My employment experience includes working for the Missouri Department of Social Services in the Division of Family Services, Child Support Enforcement, Children’s Division, and Legal Services. I also worked as a Probation and Parole Officer for the Department of Corrections. My education and employment experience have been very beneficial to practicing law. Helping others through difficult times is extremely rewarding. On a personal note, I enjoy spending time with my husband and my son. I am very fond of animals and absolutely love my dog.
